By reserving a charter or using our Service, you consent to be legally bound by these Terms. Should you not agree with any section of these terms, you are not permitted to use the Service.

2. Service Overview

OpenBookStore offers an array of high-end yacht charter services, which include, but are not limited to:

  • Day-long yacht hires
  • Evening cruises
  • Company retreats
  • Exclusive gatherings
  • Extended charters

Our services are provided based on their availability and suitable weather conditions. We have the authority to alter or cease services without prior notice.

3. Booking and Reservations

3.1 Booking Process

To reserve a charter, you are required to:

  • Be at least 18 years of age
  • Supply accurate and complete details
  • Submit the necessary deposit as outlined in your reservation confirmation
  • Accept these Terms & Conditions

3.2 Confirmation

Confirmation of your booking occurs once payment is received and our written confirmation is issued. We retain the discretion to decline service to anyone.

3.3 Availability

All charters depend on the availability of vessels and favorable weather conditions. Efforts will be made to fulfill your preferred scheduling requests.

4. Payment Terms

4.1 Pricing

All quoted prices are in € and include all applicable taxes unless stated otherwise. Prices can be adjusted without prior notice.

4.2 Payment Schedule

  • Deposit: 50% of the entire charter fee is required at the time of booking
  • Balance: Must be paid 48 hours prior to the departure of the charter
  • Extra charges (if any): Due after the conclusion of the charter

4.3 Payment Methods

Payments can be made using major credit cards, bank transfers, and certified cheques. Our payments are processed using secure and encrypted systems.

5. Cancellation and Refund Policy

5.1 Customer Cancellations

  • More than 72 hours before departure: Full refund minus transaction fees
  • 24-72 hours before departure: 50% of the amount is refundable
  • Less than 24 hours before departure: Non-refundable

5.2 Weather Cancellations

In case our captain assesses that weather conditions are not safe, we will:

  • Propose a new charter date at no extra charge
  • Issue a full refund in case of inability to reschedule

5.3 Mechanical Issues

Should there be any mechanical issues with your allocated yacht, we'll make efforts to provide a fitting replacement. If substitution isn't possible, a complete refund will be given.

6. Safety and Conduct

6.1 Safety Requirements

Passengers are obligated to:

  • Adhere to all instructions from the crew
  • Wear safety gear when specified
  • Disclose any health conditions that could impact their safety
  • Stay within designated spaces on the yacht

6.2 Prohibited Items

Certain items are prohibited onboard:

  • Glass bottles
  • Unlawful substances
  • Weapons or firearms
  • Excess beverages beyond reasonable consumption
  • Pets (unless previously approved)

6.3 Conduct

Behavior of passengers should be courteous. We reserve the right to end a charter earlier without a refund if passenger behavior is hazardous or disrupts other guests.

7. Liability and Insurance

7.1 Our Liability

Our financial responsibility is restricted to the amount you've paid for the charter. We won't be held accountable for:

  • Injuries caused by passenger negligence
  • Theft or destruction of personal belongings
  • Indirect, consequential, or exemplary losses
  • Delays arising from weather or events beyond our control

7.2 Insurance Coverage

Our organization carries comprehensive marine insurance that covers our vessels and their operation. It's the responsibility of passengers to have their own personal and travel insurance.

7.3 Assumption of Risk

By utilizing our charter services, you accept that maritime activities possess inherent dangers and you take on personal accountability for your safety and protection.

8. Modifications and Itinerary Changes

We retain the right to adjust itineraries, paths, or timetables due to weather, safety concerns, or operational necessities. We will endeavor to arrange comparable alternatives if changes are made.

9. Force Majeure

Our firm is not responsible for interruptions, cancellations, or variations stemming from situations not under our control, including, but not limited to:

  • Extreme weather
  • Natural catastrophes
  • Government directives
  • Port shutdowns
  • Unforeseen mechanical breakdowns

10. Privacy and Data Protection

The handling of your private data comports with our Privacy Policy. By engaging with our services, you consent to our data collection and usage as laid out in the Privacy Policy.

11. Intellectual Property

The creative content on our website, such as written content, imagery, trademarks, and logos, is legally protected. Unauthorized reproduction, distribution, or creation of derivative works is prohibited without explicit written consent.

12. Governing Law
